Rep Acharon files bill regulating habal-habals

Representative Pedro B. Acharon, Jr. of the 1st Districtu of South Cotabato filed House Bill 39 seeking the regulation the proliferation of habal-habals or motorcycles-for-hire in a desire to protect both their drivers and the riding public.

Acharon who is in his first term in the Lower House named it as “Motorcycles-For-Hire Act of 2010″ which grants local government units the power to regulate these vehicles.

In an interview, the neophyte congressman said that habal-habals are prevalent in many areas in the country and in some, it is the only mode of transportation.  These however are not registered and thus, their business operations are considered illegal and are not covered by insurance, he added.

“The proliferation of motorbikes-for-hire to transport passengers or goods is detrimental to the riding public because no one can claim any insurance benefit in case of accidents, ” the congressman from General Santos City said.

“The only way is by regulating their business operations to give them the chance to register their vehicles as public transport and thus, are governed by the law on common carrier.”

Under the bill, the LGU shall receive, process and evaluate all applications for the grant of franchise to operate “motorcycles-for-hire” within their territories.

Applications which pass all the requirements shall be endorsed to the local councils for issuance of franchise and a “”for hire” license plate.

Registered Habal-habals however are not allowed to operate, except to cross, along the national highway or on any road allowing a maximum speed greater than 40 kilometers per hour. Any LGU with jurisdiction over the roads can control and designate the routes.

P5,000 shall be meted the owner who fails to register the motorcycle-for-hire as a FINE and his motorcycle impounded unless it gets registered. (Based on a  report from congress.gov.ph)

    stop passing any bills/laws that are not job generating and gives more ways to kotongers to extort money. wag nyo na dagdagan pagpapahirap sa mga mahihirap, habal-habal drivers are trying to make a living, even exposing themselves to danger. give them other safe decent jobs, they will stop being a habal-habal driver.

    yung mga hinuli na mga usher ng last-two ng regional pnp 12, pakawalan nyo na at bigyan nyo na lang ng maganda at disenteng trabaho. ang mga nahuhuli yung mga mahihirap dahil wala sila ibang alternatibo ikabubuhay, yung nakikinabang ng malaki (mga financiers) e ni isa wala kasi may proteksyon.

    Dapat unahin yung pagkakaroon ng GenSan ng 2 Congressional districts… Sana naman maisip ni Congressman Acharon na 500,000+ na ang population ng GenSan at baka 600,000+ na by this year….. Grabe naman kung part pa rin tyo ng 1st district ng South Cotabato….

    @Ton… I completely agree with you that it’s about time that GenSan will have a separate congressional seat at least two(2) for the simple reason that our population now reach to 600K+. Also, for the good of Polomolok, Tupi, Tampakan constituents they also deserve a separate legislator in order that said lawmaker can focus more on the development of their municipalities. I think cong. jun should push for this bill para hindi naman tayo maiwanan. Thanks

    This is a good move for Rep. Acharon. But to think, if you compare this bill to the one which will separate the city from 1st district of So. Cot., alin ba sa tingin ninyo ang pinaka kakailanaganin ng mga constituents nya? I’m disappointed to be honest.

    there is this move by pampanga rep. former pres. gloria arroyo to revise the regional setting of mindanao….im just wondering bakit ba masyadong concern ang isang rep. ng pampanga sa luzon para sa kapakanan ng mga taga mindanao? bakit hindi pa nya ito inisip noong nasa katungkulan pa syang bilang pangulo? nararapat ba na paki-alaman ng kung sinong rep. ng lalawigan sa luzon ang mga bagay na may kaugnayan sa ikabubuti ng mga taga mindanao?

    I think, Silway River will be the dividing line between District 1 and 2 of GENSAN if ever maging 2 tlaga congressional district natin…
